Terms of Use for Digital Sheet Music and Related Services
Komaki Music,inc. (hereinafter referred to as “the Company”) hereby establishes the following Terms of Use (hereinafter referred to as “these Terms”) for the sale of sheet music and other digital content, and related services (hereinafter referred to as “the Service”) provided through the Company’s online shop “eJPC” (hereinafter referred to as “the Site”).
Before using the Service, please read these Terms carefully and use the Service only if you agree to them.
These Terms incorporate the “Important Notes” described on the “How to Purchase and Download Sheet Music” page, and both shall be applied as an integrated set of rules. In the event of any inconsistency, these Terms shall prevail.
Article 1 (Purpose and Scope)
These Terms set forth the conditions and precautions for the use of the Service.
These Terms constitute the content of the contract between the user (as defined in Article 5) and the Company.
Any separate terms or instructions established by the Company (hereinafter referred to as “Individual Terms”) shall be applied together with these Terms. In the event of any inconsistency, the Individual Terms shall take precedence.
Article 2 (Nature of Digital Content)
The sheet music data sold through the Service (hereinafter referred to as “Sheet Music Data”) does not involve the transfer of tangible property. Instead, it grants the purchaser a non-exclusive, non-transferable license to use the content.
Users shall not use the Sheet Music Data beyond the scope permitted by these Terms.
Article 3 (Returns and Cancellations)
Due to the nature of digital products, returns and cancellations after purchase are not accepted. Please confirm the content and the compatibility of your device before purchasing.
Article 4 (Use by Minors)
Minors may use the Service only with the consent of a legal guardian. If a minor uses the Service, such use will be deemed to have been approved by the legal guardian.
Article 5 (User Definition)
“User” means any person who agrees to these Terms and uses the Service.
If there is any change in the registered information, the user shall promptly notify the Company in the prescribed manner.
Article 6 (Services Provided)
The Service includes the sale and download of Sheet Music Data and any other services separately determined by the Company.
The Company may, upon prior notice, change, add, or suspend the content of the Service.
Article 7 (Preparation of Equipment)
Users shall, at their own expense and responsibility, prepare and maintain the necessary equipment and communication environment to use the Service. The Company shall not bear any such costs.
Article 8 (Copyright Licensing for Public Performance)
When performing a copyrighted work publicly (including concerts, events, broadcasts, online streaming, etc.), the user is responsible for applying for performance rights and paying copyright fees to copyright management organizations (such as JASRAC).
This does not apply when the performance meets all of the following conditions: non-profit, no income, and no compensation, or in other cases where no application or payment is required under copyright law. Please contact the relevant copyright management organization for details.
The Company does not act as an agent for applications or advance payment of copyright fees on behalf of users.
Article 9 (Restrictions on Alterations and Arrangements)
Users may not make unauthorized alterations to the product, including adding or deleting phrases or arrangements. Such acts may infringe upon the moral rights or arrangement rights of the original copyright holder.
If you wish to make arrangements or other changes, please contact the Company or the copyright holder in advance and obtain permission.
Article 10 (Prohibited Acts)
Users shall not engage in the following acts:

Registering false information

Selling, transferring, lending, or licensing user credentials to third parties

Copying, distributing, selling, lending, altering, or publicly transmitting the Sheet Music Data (whether for commercial or non-commercial purposes)

Printing more copies than reasonably necessary

Using the Sheet Music Data for AI model training or similar data analysis

Infringing the rights of the Company or third parties

Violating laws, regulations, or public order and morals

Interfering with the operation of the Service
Article 11 (Intellectual Property Rights)
The intellectual property rights for the Sheet Music Data, other content, and programs provided through the Service belong to the Company or the rightful owners.
Users may not use these beyond the scope of personal, non-commercial use.
Article 12 (Disclaimer and Limitation of Liability)
Except in cases of willful misconduct or gross negligence by the Company, the Company shall not be liable for any damages arising from the use of the Service.
The maximum liability for damages shall not exceed the purchase price of the relevant Sheet Music Data paid by the user.
Article 13 (Changes to the Terms)
The Company may revise these Terms for reasonable reasons and will notify users of the effective date in advance.
If a user uses the Service after the effective date, the user shall be deemed to have agreed to the revised Terms.
Article 14 (Governing Law and Jurisdiction)
These Terms shall be governed by the laws of Japan.
Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.
